NO PURCHASE IS NECESSARY TO ENTER OR WIN THE PRIZE.
1. Sponsor
The Sponsor of the Bristol Farms 2025 Gelato Festival Sweepstakes (“Sweepstakes”) is Bristol Farms, 915 E. 230th St., Carson, CA 90745, USA (“Sponsor”).
2. Eligibility
The Sweepstakes is open and offered only to legal residents of California, who are at least eighteen (18) years of age. Employees of Sponsor, Gelato Festival, and their immediate families (parent, child, sibling, or spouse) and/or household members of respective parent companies, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies, and any other persons or entities associated with this promotion are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations, and is void outside the United States and where prohibited.
3. Agreement to Official Rules
By participating in the Sweepstakes, Entrant agrees to be fully and unconditionally bound by these official Sweepstakes rules (“Official Rules”), and Entrant represents and warrants that they meet the eligibility requirements. In addition, Entrant agrees to accept the decisions of Sponsor as final and binding as it relates to this Sweepstakes and consents to be contacted by Sponsor by email.
4. Sweepstakes Period
Digital entries only. Sweepstakes begins on Saturday, July 12, 2025 at 12:01am Pacific Daylight Time (“PDT”) and ends on Saturday, August 16, 2025 at 11:59pm, PDT (the “Sweepstakes Period”). All entries must be received during the Sweepstakes Period. Sponsor’s computer (or that of its designee for this Sweepstakes) is the official time keeping device for online entry into the Sweepstakes.
5. How to Enter
To enter, Entrant should visit the Bristol Farms website landing page at [www.bristolfarms.com/gelato-festival] (and available in-store) and complete the online entry form which includes providing a first and last name, email address, phone number, and preferred Bristol Farms store location. Entrants may also enter via electronic tablet at any Bristol Farms store. The entry must be complete and eligibility must fulfill all Sweepstakes requirements, as specified in these Official Rules, to be eligible to win the Prize. Entries that are incomplete or do not adhere to these Official Rules may be disqualified at the sole discretion of Sponsor. Entrant may enter only once. Entrant must provide the information requested. Entrant may not enter more than once by using multiple email addresses, identities, or devices in an attempt to circumvent the Official Rules. If Sponsor discovers or reasonably suspects that Entrant has used fraudulent methods or otherwise attempts to circumvent the Official Rules, entries, Entrant will be disqualified. By submitting an entry, Entrant represents and warrants that all of the information provided as part of their entry is accurate, does not violate any third party’s legal rights (including without limitation rights of privacy and publicity), and otherwise does not violate applicable law.
6. Prizes
There are three prizes. The selected winner of the Sweepstakes (the “Selected Winner”) will be given the Prize, which is two (2) All Inclusive Flex Passes to the 2025 Gelato Festival taking place on August 30-31, 2025 at Ovation Hollywood, 6801 Hollywood Blvd, Hollywood, CA 90028. Approximate retail value of each prize is [$240]. Total retail value of all prizes is [$720]. Any and all Prize-related expenses, including without limitation transportation costs, shall be the sole responsibility of Selected Winner. The winning of the Prize is a taxable event, and if the aggregate prize for any person in any calendar year from Sponsor amounts to $600 or more, the Selected Winner will receive a tax for 1099 and will be required to provide their social security number, regardless of the prize value of the individual prize. No substitution of Prize or transfer/assignment of Prize to others or request for any special privilege by Selected Winner is permitted, except by Sponsor, who reserves the right to substitute the prize for something of equal or greater value for any reason. Acceptance of Prize constitutes permission for Sponsor to use Selected Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. Prizes are awarded “AS IS” with no warranty, representation or guarantee, express or implied, in fact or in law, made by Sponsor or for which Sponsor shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE.
7. Odds
The odds of winning depend on the number of eligible entries received by Sponsor.
8. Selected Winner Selection and Notification
Three (3) Selected Winners will be chosen by a random drawing on or about [8/18/25] by or under the supervision of Sponsor from among all eligible entries received by Sponsor. The Selected Winner will be notified within forty-eight (48) hours following selection of the Selected Winner, by email. Sponsor shall have no liability for the Selected Winner’s failure to review messages or email notices from Sponsor due to SPAM filters, telephone block systems or other technology challenges or security settings or for the Selected Winner’s provision of incorrect or otherwise non-functioning contact information. Selected Winner will have 48 hours to reply by email only. If the Selected Winner cannot be contacted, is ineligible, or fails to claim the Prize within 48 hours, the Prize may be forfeited and an alternate Selected Winner may be selected by Sponsor, up to one time. Receipt by the Selected Winner of the Prize offered in this Sweepstakes is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY THE SELECTED WINNER (AT SPONSOR‘S SOLE DISCRETION) WILL RESULT IN THE SELECTED WINNER’S DISQUALIFICATION AS SELECTED WINNER OF THE SWEEPSTAKES, AND ALL PRIVILEGES AS SELECTED WINNER WILL BE IMMEDIATELY TERMINATED.
9. Prize Distribution and Approximate Retail Value (“ARV”)
The Prize distribution and ARV is as follows:
- Three (3) Selected Winners will each receive two (2) All Inclusive Flex Passes to the 2025 Gelato Festival taking place on August 30-31, 2025 at Ovation Hollywood, 6801 Hollywood Blvd, Hollywood, CA 90028
- The ARV of each Prize (2 tickets) is $240.00. The total combined ARV of all prizes is $720.00
10. Prize Delivery
Selected Winners will receive an email containing a digital QR code which will be scanned to enter the event. If Winner does not receive the email or does not have access to a scannable mobile device, Winner can meet with one of the Bristol Farms team members at the entrance to obtain their tickets.[Text Wrapping Break]
11. Declaration of Eligibility
The Selected Winner may be required to execute and return to the Sponsor a declaration of eligibility (the “Declaration”), and Selected Winner must provide a valid California ID card, in person, to claim the prize. By completing, signing and returning the Declaration, the Selected Winner (i) releases and forever discharges the Sponsor, its affiliates and subsidiaries, and their respective advertising and promotional agencies from all claims, demands, damages, actions and causes of action arising out of participation in this Sweepstakes or to arise by use of the Prize, and (ii) confirms compliance with these Official Rules. If the Selected Winner is unable or unwilling to complete the Declaration in its entirety, Selected Winner forfeits the Prize.
12. Taxes
Taxes, if any, are the sole responsibility of the winner.
13. Terms & Conditions
Sponsor reserves the right to correct typographical errors that may result in unintended interpretations of these rules. Sponsor also reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes should a pandemic, public health emergency, computer virus or bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Sweepstakes. In such case, Sponsor may select the Selected Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Official Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to: (a) multiple entries from the same user from different IP addresses; (b) multiple entries; or (c) the use of bots, macros, scripts, or other technical means for entering. Any attempt by an individual to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws. Should such attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.
14. Limitation of Liability
By entering, Entrant agrees to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) Entrant’s participation in the Sweepstakes and/or Entrant’s acceptance, possession, use, or misuse of the Prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error in the administration of the Sweepstakes or the processing of entries; and (vi) participation in any Prize-related activity (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
15. Disputes
THE SWEEPSTAKES ARE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in the Sweepstakes, Entrant agrees that the only remedy for dispute relating to this Sweepstakes is an entry. Any disputes relating to the receipt of the Prize that cannot be resolved between Entrant and the Sponsor, shall be resolved individually, without resort to any form of class action, exclusively before a court of competent jurisdiction located in Los Angeles County, CA. Further, in any such dispute, under no circumstances shall Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes). Entrant further waives all rights to have damages multiplied or increased.
16. Privacy Policy
Information submitted by Entrant in connection with the Sweepstakes is subject to the Privacy Policy stated on the Sponsor website. All personal information collected by Sponsor will be used for administration of the Sweepstakes. In addition, independent of the Privacy Policy, Entrants may receive email correspondence from, or on behalf of Sponsor. Sponsor uses reasonable commercial efforts to comply with Federal CAN-SPAM guidelines and to supply information to entities that comply with CAN-SPAM guidelines, and Entrants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email. Any questions regarding privacy matters should be directed to the email address set out in Section 17 below.
17. Selected Winners List
To obtain a copy of the Selected Winner’s name or a copy of these Official Rules, after 90 days, send an e-mail request with the words Bristol Farms 2025 Gelato Festival Sweepstakes, to [hello@bristolfarms.com] no later than 12:00AM, PDT on December 31, 2025.
